Terms of Service
Welcome to Muse Style. These Terms of Service (“Terms”) are a binding agreement between you and Spike Labs, Inc. (“Spike Labs,” “we,” “our,” or “us”) and govern your use of the Muse Style mobile application, musestyle.com, and related services (collectively, the “Service”). By using the Service you agree to these Terms and to our Privacy Notice.
ARBITRATION NOTICE. Except for certain kinds of disputes described in Section 13, you agree that disputes between you and Spike Labs will be resolved by binding, individual arbitration, and you waive your right to a jury trial and to participate in a class action.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement and that any information you provide is accurate.
2. The Service
Muse Style is an AI personal stylist: it analyzes a photo you provide to estimate your colour palette, builds outfit recommendations from third-party retailer products matched to your palette, budget, and taste, generates styled images depicting you in those outfits (“Fits”), and lets you chat with an AI stylist. The Service works anonymously by default; you may optionally save your profile with a phone number or email address.
3. Your content and licence
- You retain ownership of the content you provide (including your photos and chat messages).
- You grant Spike Labs a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, and display your content solely to operate and improve the Service — including processing your photo through AI providers to produce your colour analysis and generated Fits.
- You may only upload photos of yourself (or of someone who has given you their consent). Do not upload photos of minors.
- Generated Fits are provided for your personal, non-commercial use. If you share a Fit, you are choosing to make that page viewable by anyone with the link.
4. AI-generated content
Fits, colour analyses, and stylist chat are generated by artificial intelligence. They are style suggestions, not guarantees — generated images are illustrative and may not perfectly represent how a product will look or fit on you, and product details (price, availability, colour) are controlled by the retailer and may change. Verify details on the retailer's site before purchasing.
5. Shopping, retailers, and affiliate links
- Products recommended in the Service are sold by third-party retailers, not by Spike Labs. Your purchases are made on the retailer's site under the retailer's terms, prices, and policies. We are not a party to those transactions and are not responsible for retailer products, shipping, returns, or support.
- Some links are affiliate links: we may earn a commission when you buy through them, at no additional cost to you. See our Affiliate Disclosure.
6. Acceptable use
You agree not to: misuse or interfere with the Service; attempt to access other users' data; upload unlawful content or content that infringes others' rights; use the Service to harass or harm anyone; reverse-engineer or scrape the Service; use generated images to mislead or impersonate; or circumvent our commerce/attribution systems.
7. Accounts
If you save your profile, keep your contact method secure — anyone who can receive your verification codes can access your account. You can delete your profile at any time in the app; deletion removes your contact identity and stored photo, and your device may continue anonymously.
8. Intellectual property; feedback
The Service — including software, design, models, and content other than your content — is owned by Spike Labs and its licensors and protected by law. If you send us feedback, you grant us an unrestricted, irrevocable licence to use it without obligation to you.
9. Copyright complaints (DMCA)
We respond to notices that comply with the Digital Millennium Copyright Act. Send notices to support@musestyle.comwith “DMCA” in the subject, including the information required by 17 U.S.C. § 512(c)(3).
10. Termination
You may stop using the Service at any time. We may suspend or terminate access at any time for any reason, including violation of these Terms. Sections that by their nature should survive (including 3, 8, 11, 12, 13, and 14) survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOMMENDATIONS OR GENERATED IMAGES WILL MEET YOUR EXPECTATIONS.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPIKE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limits, so they may not fully apply to you.
13. Dispute resolution; binding arbitration
Any dispute arising out of these Terms or the Service will be resolved by binding, individual arbitration administered by JAMS under its rules, rather than in court, except that either party may bring claims in small-claims court or seek injunctive relief for intellectual-property misuse. You and Spike Labs each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing support@musestyle.com within 30 days of first accepting these Terms, with your name and a clear opt-out statement.
14. General
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. If a provision is found unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Spike Labs regarding the Service. We may update these Terms; material changes will be notified in the app or on this page, and continued use constitutes acceptance.
