Privacy Notice

Spike Labs, Inc. (“Muse Style,” “we,” “our,” or “us”) respects your privacy. This Privacy Notice explains how we collect, use, disclose, and retain information when you use the Muse Style mobile application, musestyle.com, and any other service that links to this notice (collectively, the “Services”). Your use of the Services is also governed by our Terms of Service.

1. Information we collect

Information you provide:

  • Style profile — your brand preferences, budget, occasions, and sizing details you enter during onboarding or in the app.
  • Your selfie — with your consent, a photo you take or choose. We use it to derive your colour analysis (skin, hair, and eye tones → a seasonal colour palette) and as the visual reference to generate styled images of you (“Fits”). See Section 2 for exactly how photos are used.
  • Account details (optional) — the Services work anonymously by default. If you choose to save your profile, we collect your phone number and/or email address (verified by one-time code through our authentication provider) and, optionally, your name.
  • Chat — messages you exchange with Muse, our AI stylist.
  • Support — messages and attachments you send us.

Information we collect automatically: a random device identifier we generate for your installation; device and usage data (OS version, in-app events, pages viewed, crash logs); approximate location from IP address; product interactions (which recommendations you view, tap, save, or share); and cookies or similar technologies on the website.

Information from third parties: if you link your account, our authentication provider (Clerk) shares your verified phone/email; affiliate networks may report aggregate purchase events attributed to our links (never your payment details).

2. Photos and AI-generated images

  • Your selfie is processed by AI models to (a) estimate your colour characteristics and (b) generate styled images that depict you wearing recommended outfits.
  • Photo processing is performed by our AI infrastructure providers (see Section 4) solely to provide the Services.
  • We do not use your photos to train AI models, and we contractually require our AI providers not to train on them.
  • Generated images of you are private by default. They become visible to others only if you choose to share a look, which creates a link-accessible page you control.
  • You can delete your photo and generated images at any time — see Section 6.

3. How we use information

  • Operate, maintain, and improve the Services — including your colour analysis, outfit recommendations, and generated Fits.
  • Personalize your experience — remember your palette, budget, taste, and history so Muse gets better for you over time.
  • Communicate with you — service notices and, with your consent, messages from Muse (for example, texting you a new Fit) which you can turn off at any time.
  • Measure and improve — analytics, debugging, and product research.
  • Attribute commerce — when you tap a product we record the click (product, look, surface, timestamp) so purchases can be attributed; we never place your name, contact details, or photos in outbound links.
  • Safety and legal — prevent fraud and abuse, enforce our Terms, and comply with law.

4. How we disclose information

We do not sell your personal information. We disclose it only to:

  • Service providers acting on our behalf — cloud hosting and databases (Vercel, Neon), authentication (Clerk), AI model providers for image and language processing (including OpenAI, Anthropic, and Google), job processing (Trigger.dev), realtime messaging (Ably), analytics and diagnostics (PostHog, Google Analytics, Sentry).
  • Affiliate networks (such as Sovrn Commerce and Awin) — receive click events with an anonymous click identifier so purchases can be attributed; they never receive your name, contact details, or photos from us.
  • People you share with — if you share a look, anyone with the link can view that page (your generated image, the outfit, and its products).
  • Legal and safety — where required by law or to protect the rights, safety, and property of Spike Labs, our users, or others.
  • Corporate events — in connection with a merger, acquisition, financing, or sale of assets, subject to this notice.

5. Cookies & analytics

The website uses cookies and similar technologies for analytics, performance, and preferences (including Google Tag Manager, Google Analytics, and PostHog). Most browsers let you refuse or delete cookies; the Services remain usable without them, though some features may degrade.

6. Your rights & choices

  • Delete your profile — in the app (Save my profile → Delete my profile) or by emailing us. Deletion removes your contact identity and your stored selfie; your device can continue using the Services anonymously.
  • Access, correction, portability — email us and we will honor applicable requests.
  • Marketing & messages — opt out of any Muse messages via in-app settings, reply STOP to texts, or the unsubscribe link in emails.
  • California residents — you have the rights to know, delete, correct, and to non-discrimination under the CCPA/CPRA. We do not sell or “share” personal information as defined by the CPRA.
  • EU/UK residents — we process your data on the legal bases of contract performance, legitimate interests, consent (for photos and marketing), and legal obligation; you may lodge a complaint with your supervisory authority.

7. Data retention

We keep personal information only as long as needed for the purposes above: your profile and photos until you delete them or your account; click and analytics records in identifiable form only as long as needed for attribution and reporting, then aggregated or deleted; backups on a rolling schedule.

8. Security

We use industry-standard safeguards — encryption in transit, access controls, and secrets management — to protect your information. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

9. International transfers

We are based in the United States and process data there. If you use the Services from elsewhere, you understand your information will be transferred to and processed in the U.S.

10. Children

The Services are not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.

11. Changes

We may update this notice from time to time. We will post the updated version here and revise the “Last updated” date; material changes will be notified in the app or by email.
